1. INTRODUCTION
Eckler Cleaning Services is hosting a Dirtiest Bathroom Challenge for this spring. With this challenge, we will be giving one lucky winner a free bathroom cleaning, up to 3 hours! With the option to upgrade, for a price, to clean the rest your home too. This giveaway begins at 12:00 a.m. Eastern Standard Time on February 5, 2022 and ends at 11:59 p.m. Eastern Standard Time on February 28, 2022. By entering the Giveaway, entrants unconditionally agree to be bound by and abide by all terms of these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries and entrants, and the selection of the winner), whose decisions shall be final and binding.
2. HOW TO ENTER AND PARTICIPATE:
Post a picture of your bathroom to Facebook. Tag Eckler Cleaning Services’ Page. Use the hashtag #ecklercleanmybathroom. Like Eckler Cleaning Services’ page.
3. OFFICIAL RULES:
1. Winner must live within 10 miles of Plainfield, IN.
2. Winner, at time of entry, must 18 years or older, and a legal resident of the United States.
3. Entries must be posted no later than 11:59 p.m. Eastern Standard Time on February 28, 2022. One winner will be chosen by Sponsor by the dirtiest bathroom posted, with all rules followed on or soon after March 1, 2022.
4. Winner must live within home of bathroom posted.
5. Winner must allow for Eckler Cleaning Services to take and post before and after pictures online without compensation.
NOTE* Eckler Cleaning Services does not have licenses or issuances to clean any biohazards. Any bathroom with biohazards with be dismissed.
4. OPERATION OF GIVEAWAY
Sponsor reserves the right to disqualify all entries that fail to comply fully with these Official Rules. Sponsor assumes no responsibility for lost, misdirected, late, incomplete, or illegible entries or for failure to receive entries for any reason, including, without limitation, transmission failures, technical failures of any kind, malfunctioning of any network, hardware or software, or errors in sending, receiving or processing data, whether originating with sender or Sponsor. Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Giveaway.
5. SELECTION OF WINNERS
Prizes must be accepted as awarded. Prizes are non-assignable and non-transferable. No substitution is allowed, except that Sponsor, in its sole discretion, reserves the right to substitute a prize of equal or greater value. The value of the prize is taxable as income. Prize winner is solely responsible for all costs, taxes, fees, and applicable federal, state and local taxes regarding the prize.
No construction, trash removal, move-in, move-out, or commercial cleanings will be eligible.
6. NOTIFICATION OF WINNER
Sponsor, Eckler Cleaning Services, will attempt to notify the winner on or soon after March 1, 2022 by Facebook messenger. The name of winner will be posted to http://ecklercleaning.com and Eckler Cleaning Services’ Facebook page on or soon after March 1, 2022. Participants are responsible for checking the receipt of all contact. If the winner cannot be contacted within three days of the first attempted contact, or if eligibility requirements are not met, or if a winner has not or does not otherwise comply with the terms and conditions of this Giveaway, the winner will be deemed ineligible, and another random drawing will be used to select the winner. The prize must be claimed before March 4, 2022. Winner may be required to complete an affidavit of eligibility and liability/publicity release (except where prohibited by law), which must be returned within ten days of receipt. Failure to sign and return the affidavit and/or release within such period, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification and the forfeiture of the winner’s prize. In such event, Sponsor reserves the right to determine if and when a prize will be re-awarded and the applicable terms.
7. GENERAL CONDITIONS
This Giveaway is subject to all federal, state and local laws, rules and regulations. Sponsor reserves the right to disqualify any entry or entries, or any individual, it finds to be tampering with the entry process or the operation of the Giveaway or website; to be acting in violation of these Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
8. PUBLICITY NOTICE
By entering the Giveaway, each entrant grants Sponsor permission to use the person’s name, likeness, voice, photographs, video, opinions, statements, and email address, for promotional purposes. Any use of the forgoing information may be in any manner or media now or hereafter known or existing, worldwide, in perpetuity and without compensation, notice or further consent, unless prohibited by law.
9. LIMITATION OF LIABILITY; RELEASE
The winner, by accepting a prize, agrees to release and hold harmless Eckler Cleaning Services and its employees from any and all liability, claims or actions of any kind whatsoever, which may result from the award, receipt, enjoyment, ownership or use or misuse of the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the entrant’s rights of publicity or privacy, or the entrant’s claim that he/she has somehow been defamed or portrayed in a false light).
Sponsor does not assume any responsibility for any schedule changes in the Giveaway timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Giveaway schedule. Sponsor reserves the right to cancel, modify, or suspend this Giveaway.
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR GIVEAWAY ENTITIES IN CONNECTION WITH THIS GIVEAWAY SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF INDIANA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS GIVEAWAY AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN DANVILLE, INDIANA HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR GIVEAWAY ENTITIES IN CONNECTION WITH THIS GIVEAWAY AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.
